Parties to the Terms

The XCEL TECH Terms and Conditions (hereinafter referred to as these “Terms”) is the document that sets out the terms concluded for buyers to purchase products from the XCEL TECH subordinate to http://luba.com.au. Once the buyer (hereinafter referred to as “you”) has placed an order in the XCEL TECH Online Store, you hereby state and guarantee that you have the ability to agree to and sign the clauses in these Terms.

 

Pictures and Advertisements

The information included in the XCEL TECH Online Store is nothing more than invitation for offer. Any such information does not constitute an offer by theXCEL TECH Online Store to provide any product or service.

The pictures, videos and words displayed on the XCEL TECH Online Store may not be the same as the actual products due to different batches and technology advancement. There may also be errors due to careless omissions in the review process. XCEL TECH Online Store always strives to provide all customers with objective and correct content and pictures, but takes no responsibility for any incorrect information  Sthat has not been subject to proofreading, or for any misunderstandings due to differences in interpretation.

Pricing and Adjustment

XCEL TECH reserves the right to change the price of the products displayed on the XCEL TECH Online Store based on the actual market situation. Despite our best efforts, a small number of the items on our catalogue may be mispriced. We will verify pricing when processing your order and before we take payment. If we have made a mistake and a product’s correct price is higher than the price on the XCEL TECH Online Store, we may either contact you before dispatch to request whether you want to buy the product at the correct price or cancel your order. If a product’s correct price is lower than our stated price, we will charge the lower amount and send you the product.

XCEL TECH has the right to correct any unintentional mispricing. In the event of a pricing error, you will be notified and will be allowed to continue trading at the correct price.

 

Order Receipt and Confirmation

When you place an order from XCEL TECH Online Store, your order constitutes an offer to purchase products or services from us. If your order contains multiple products or services, your order will contain a series of offers for each product or service.

Once we have received your order, we will send you an order confirmation email. However, your receipt of the above email does not constitute confirmation that we have accepted your order, nor does it constitute a confirmation of our offer to sell. It simply means that we have confirmed receipt of your order.

Once we have handled your order and are ready to ship the products, we will send you another email indicating that we have accepted your order, which will include shipping details once the shipment is ready and has been dispatched from the warehouse.

Within 15 days of the shipment of the order, if you did not receive the product, please contact [email protected]. We will reship the product or provide refund or reimbursement according to the actual situation and our communication.

We have the right to decide whether to accept your order. The XCEL TECH Online Store will only accept your order after we have confirmed that the stock, logistics, policies and all other objective conditions can be satisfied. If the XCEL TECH Online Store has fulfilled your order but later discovers that we cannot offer the products or services, or if you are engaging in scalping, malicious competition, or purchasing in violation of our purchase limitation, etc., we will cancel the order and fully refund the purchase price to you.

 

Logistics and Delivery

For non-pre-order products, the XCEL TECH Online Store processes the order within 2 business days after the order was placed.

TheXCEL TECH Online Store will choose the most suitable shipping company to provide the service according to the shipping address.

The shipping time should be subject to the time announced by the third-party shipping company. Once the products of your order leave our warehouse, the actual delivery may be affected by events which are beyond XCEL TECH’s control. Thus, XCEL TECH does not assume any responsibility for any delay in delivery due to unexpected logistics related events.

If any logistics delay occurs, you may send an email to [email protected], and we will do our best to contact the logistics company to help resolve the issue.

 

Order Cancellation

For in-stock products, we accept order cancellation before the product is shipped or produced. For pre-order products, we accept order cancellation before the product is shipped or production begins, subject to XCEL TECH’s instruction regarding specific pre-order products on the XCEL TECH Online Store.

If the order is cancelled within 24 hours of placing the order, no fees will be charged.

If the order is cancelled after 24 hours of placing the order and the order has not been shipped out, please note that we will charge a transaction fee for the refund (3.8% for credit card users, 3.9% for PayPal users, 5.9% for Afterpay users, 4.9% for Zippay users).

We cannot cancel the order if the product is already shipped out.

 

Return and Refund Policy

We accept product returns. Users have the right to request a return within 30 calendar days without providing reasons after product delivery, subject to the following return conditions: Return and Refund Policy

 

After-sales Service

XCEL TECH will provide after-sales service based on the after-sales policy on the XCEL TECH Online Store. For specific service terms, please refer to After Sales Policy: Warranty Policy

 

Reselling forbidden

XCEL TECH Online Store sells and delivers products to end-users/customers only. Any purchase of products from XCEL TECH for the purpose of reselling is forbidden. We reserve the right to refuse or cancel your order if we have reasonable grounds to believe that you are not purchasing the products for personal use.

 

 

Data Protection

Once you have placed an order, this means you agree that XCEL TECH Online Store may collect, store, share, process or use the data you provided for the purchase of the product or service. This also means that you agree for your data to be archived and/or circulated within http://luba.com.au, so you can receive information regarding XCEL TECH products or services that may interest you.

 

Disclaimer; Limitation of Liability

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

You hereby acknowledge and agree that unforeseeable circumstances may arise during the product use, leading to further personal injury or property damage arising from any damage to surrounding facilities/items caused during the use.

To the fullest extent permitted by law, XCEL TECH shall not be liable for any legal responsibility or obligation for any further personal injury or property damage arising from any damage to surrounding facilities/items caused during the product use. (Including but not limited to direct, indirect, incidental, special, punitive, or consequential damage).

You declare that you will be responsible for your safety and will conduct the product use under all applicable safety requirements. You agree to take responsibility for any further personal injury or property damage arising from any damage to surrounding facilities/items caused during the operations.

In no case shall XCEL TECH Online Store, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

 

Force Majeure

If XCEL TECH Online Store can not fully fulfill the obligations of these Terms due to force majeure, we will notify you within 15 days from the date of the force majeure (if the notice can not be delivered within the aforementioned period due to a force majeure incident, XCEL TECH Online Store will notify you within 15 days after the conditions of the incident have been eliminated). If XCEL TECH Online Store fails to fulfill the Terms due to force majeure, we shall be wholly or partially exempt from liability or responsibility. Force majeure events include, but are not limited to, earthquakes, flooding, lightning strikes, snowstorms, and government action.

 

Protocol Conflict

These Terms applies to all products sold at XCEL TECH Online Store. If XCEL TECH Online Store makes any specific sales policy for any product, and there exist conflicts between the product sales policy and these Terms, please take the product sales policy as the standard.

 

Governing Law

These Terms and any separate Terms whereby we provide you services shall be governed by and construed in accordance with the laws of Australia.
